With the American court system, he'd be OK for about two and a half years until the system got around to setting a court date, and then would be able to appeal through circuit courts, county courts, state superior courts, and then again through all the levels of the Federal courts. It could actually go on until even Data got bored of the whole situation.

Forgot to mention that if he were actually imprisoned, he'd be able to continue his appeals plus instigate lawsuits - at the cost of the penal system.

Plus, if he was imprisoned he could easily just break out of prison and they would have no way to stop him.

Yes they would - Data's tough, but being bulletproof does not equal being RPG proof.
