It's not just the Patriot Act though you'll find more and more of these things pointing to it as justification. It's also got to do with many, many out of date laws conceived when the height of telecommunications was a phone with a rotary dial being used to regulate what can and cannot be done with digital communications. Out of date laws, no firm stance on privacy from the government, and things like the Patriot Act are all mixing together into a shit storm of epic proportions.
